Across India, thousands of families are living the same story.

They paid for a home. They were promised delivery in two or three years. Years have passed.

The home isn’t ready.  The builder keeps giving new timelines, and the family keeps waiting
while paying both EMI and rent.

This is not rare. This is happening everywhere.

Here’s What Most People Don’t Realize

You are not stuck because the system is weak. You are stuck because the system is not being used.

India already has a law designed to protect you: the Real Estate (Regulation and Development) Act, 2016 (RERA).

Most people have heard of it. Very few actually use it.

Your Money Is Supposed to Be Protected

This is where things get serious.

Under RERA:

👉 70% of the money collected from buyers must be kept in a separate escrow account
👉 That money can be used only for the construction of that specific project

This is not optional.
It is a legal requirement under Section 4(2)(l)(D) of RERA.

So What Does This Mean for You?

If your project is delayed for years, ask yourself:

  • Where did your money go?
  • Why is construction still incomplete?

Because legally:

👉 Your money cannot be used for another project
👉 Your money cannot be diverted for personal investments

If it is:

👉 That is illegal
👉 That is a criminal offense
👉 That can lead to penalties, prosecution, and even jail time for the builder

What RERA Actually Gives You

If your builder delays your home:

  • You are entitled to interest (≈10–11% annually)
  • You can claim rent compensation
  • You can exit and demand full refund with interest
  • You can refuse possession of an incomplete unit
  • Without an Occupancy Certificate, the home is not legally ready

These are not favors. These are your rights.

Maintenance Charges? Know This First

Many builders start charging maintenance early.

But legally:

  • No Occupancy Certificate → No valid possession
  • No full completion → No maintenance liability

👉 Maintenance is for maintaining a completed property
👉 Not for funding an incomplete project

The Hidden Cost of Waiting

Let’s put numbers to it. If you paid ₹50 lakh for a home 5 years ago:

  • That money is now worth ₹80–85 lakh (with interest)
  • Rent paid adds another ₹8–10 lakh
  • Add stress, compromise, and lost opportunities

The real cost is not what you paid.
It’s what you’ve lost.

Why Builders Get Away With It

Not because they are above the law.

Because most people:

  • Don’t know their rights
  • Don’t question fund usage
  • Don’t file complaints
  • Keep waiting

And as long as people wait,
nothing changes.

If You’re Facing a Delay, Do This

Step 1: Ask for

  • Occupancy Certificate (OC)
  • RERA registration details

Step 2: Ask directly:
👉 Where is the escrow account?
👉 How is buyer money being used?

Step 3: Document everything

Step 4: File a complaint under RERA

Step 5: Claim what is legally yours

  • Interest
  • Rent
  • Compensation
  • Or full refund

A Simple Truth

Your money is not supposed to disappear. Your home is not supposed to be delayed indefinitely.

And your rights are not optional.

This is not just about one project or one builder. This is about awareness.

When buyers understand:

  • where their money goes
  • what the law requires
  • and how to act

The system starts working. Until then, delays will continue, money will move quietly, and people will keep waiting.
